1.      This Deed of public charitable trust executed in Delhi on this 17th day of February 2015 by Mr. Jitendra Kumar Yadav S/o Hari Har Singh Yadav R/o Village, Kashipur Post Gauriya, Sitapur, Utter Pradesh, 261001  representing the Settler/Author of the Trust which expression unless repugnant to the context or meaning thereof includes their heirs, executors, and administrators, etc., whereas settler of the Trust are possessed of and otherwise well and sufficiently entitled to the sum of Rs. 1, 100/-(Rupees One thousand one hundred only)  hereinafter referred to as said property.

WHEREAS the following persons are trustees in Trust for the purposes detailed in this Trust Deed:

      Mr. Jay pal Singh S/o Mullu R/o Village, dameala Manpur Tehsil. Bishva Sitapur (Utter Pradesh)



      Whereas the Author of the trust is desirous of creating a public charitable Trust with a motive to serve the society at large by making available higher and further technical education, health facilities, women empowerment programs, self employment in agriculture sector, pollution prevention, social awareness, child welfare for human development in rural areas and all the basic needs of a person to lead a normal life at cost affordable to the general public of the society without any motive to make any profit or to have any other form of gain by doing so. These objects and purposes are expressed in this Trust deed under clause 2 of this deed.

NOW THIS DEED OF DECLARATON WITNEESETH:

1.      NAME , OFFICE AND AREA OPERATION:
2.      The name of the trust shall be KISAN PRAGATI” The trust office presently shall be at  H.No.1072 Gali No. 70 Devaram Park Tri Nagar Landmark Delhi 110035 However, the trustees may change it from time to time on the basis of majority decision. The term Trustee shall mean the trustees of the said KISAN PRAGATI” Area of operation of trust shall be All Over in India.
2.      OBJECTS / GUIDELINES OF THE TRUST ARE:

The main trust area of activities and objectives of the Trust shall be promote agriculture by providing agricultural education and doing other activities related horticulture and to provide higher and further technical education, organize and take-up health facilities in, pollution prevention, women empowerment programs, self employment in agriculture sector, Social awareness, child welfare for human development in rural areas and all the basic needs of a person to lead a normal life at costs affordable to the general public without any profit-making motive or to have any other form of gain by so doing.
Without affecting the generality of the above-mentioned objectives, the specific objectives to be achieved and activities to be undertaken are:

1.      To promote horticulture, Fruit Preservation, Mushroom cultivation, sericulture, Poultry, Pisiculture&Fisheries, Organic Farming, Fruit Production,  Bee Keeping, and animal Husbandry,Dairing
2.      To Promote Agriculture Knowledge Extension, and Agriculture Entrepreneur, Area wise Agriculture survey  Input Analysis& Research, Agriculture Probability Analysis,
3.      To promote the conservation of the physical and natural environment by promoting biological diversity
4.      To promote the creation, development, preservation and maintenance of gardens (preference will normally, but not exclusively, be given to gardens accessible to the public); and the advancement of horticultural education
5.      To plant, grow, cultivate, produce, and raise plantations of various forest species of proven utility and other agricultural, plantation, horticultural crops, medicinal and aromatic plants and to buy, sell, export, import, process, distribute, or otherwise deal with all kinds of forest crops, natural products agricultural, plantation and horticultural crops, medicinal and aromatic plants and alternative nature / Eco-farming
6.      To provide education to underprivileged children along with basic stationary, clothes, footwear, eatables, education, and much more
7.      To provide health education to adults and adolescents in both sex people through propagation the importance of health food, exercise & yoga.
8.       To provide basic medical facility, sanitation, general health care and other needful support which can be helpful for public to overcome sufferings and agony of any natural and manmade disaster and to facilitate them to rehabilitate in rural areas.
9.      To provide counseling to develop a better understanding and their individual growth as well as transforming them for their positive contribution to the society
10.  To provide the relief of financial need and suffering among victims of natural or other kinds of disaster in the form of money for persons, bodies, organizations and also educate them to know the prevention activities.
11.  To provide relief and assistance of people in any part of the country who are the victims of war or act of nature disaster, manmade disaster, trouble, or catastrophe in particular by the supply of medical aid to such persons.
12.  To facilitate an equitable share for minority communities in education, employment, economic activities and to ensure their upliftment.
13.  To establish Nursery, Primary, High School. Higher Secondary School colleges and similar educational institutions like hotel Management and catering technology institutes, fashion Designing, food processing, polytechnics, engineering colleges, Teacher training institutes, nursing schools, medical colleges etc. And to maintain book banks, entrance examination, coaching Centers, reference rooms, study classes, hotels and vocational Trainings for the benefit of the public.
14.  To improve the socio-economic conditions of the minority communities and to provide financial assistance to the poor and meritorious students belonging to minority communities to enable them to pursue professional and technical courses.
15.  To make people aware about corruption and mobilize them to fight against the culture of corruption to build a powerful and leading nation.
16.  To work for women empowerment, basic education to women, safety for women and standing up for women's rights are being practiced by full throttle.
17.  To undertake the propagation of literacy through adult & non-Formal education Proprammes and projects for the purposes of Achieving 100% literacy.
18.  To spread awareness among the people by way of advocacy, organizing camps, seminar, conference, programs etc for the attainment of objectives of trust.
19.  To reduce child labor, crime prevention against women through improving in education, providing training and all other means which lead reduction in child labor.
20.  To initiate people to value the importance of nature and alternative nature / Eco-farming  farming and which will lead to sustainable development, and launch programs for plantation.

21.  To organize and take up pollution control, garbage management, Hazardous and Solid Waste Management, Environmental Planning, green environment, Ozone Layer Depletion and Disaster Management for society.

22.  To organize and take up various activities covering environmental issues related to industries, protected areas, biodiversity, urban agglomeration, environmental awareness, human resource development, Renewable energy, Energy conservation, Bio-medical waste, Solid waste management, water, noise and air pollution control and environmental  research for society.                                                     
23.  To make efforts for the education, welfare and development of women, children, below poverty line and backward community in both rural and urban area throughout the country.

24.  Empowerment to the people of their rights, duties in a democratic set up of the society and to live with harmony and for the betterment of the society.
25.  To provide all facilities like education, health, shelter, food, clothes etc to all needy persons in rural areas and to do all types of social activities for the development of Human being.
26.  To provide transportation, libraries, laboratories, reading rooms, hostels, and other necessary facilities to the students connected with the activities of the above indicated higher and further technical educational and vocational training institutions.
27.  To engage, employ or hire appropriate staffs, workers, legal experts and other professionals, managers and agents for the work and furtherance of the aims and objects of the trust and to pay their wages, salaries, stipends or fees.
28.  To carry on academic and vocational education and training and also to carry on research in the field of technical & scientific knowledge without any motive to make any profit.
29.  Advancement of education including the establishment, endowment, maintenance of educational institutions for the literacy of general masses of the people living below poverty line but not for profit. To give scholarships, Prizes, and monetary assistance to the poor students to help them in their studies.
30.  To integrate development of rural areas, rural communities, rural industrial centers, agriculture, handicraft including programmes by providing education & organizing different types of programmes.
31.  To spread awareness amongst people about their democratic & fundamental rights and to provide and facilitate legal assistance to underprivileged and poor section of society to fight for their rights and justice.
32.  To undertake development programmes of ponds deepening, Construction check dams, rainwater harvesting and watershed projects to improve Ground water level and enrich water sources.
33.  To put the persons those violate the human rights in to legal action and try get severe punishment for them.
34.  To do projects for promoting social and economic welfare/uplift of the public in any rural and urban areas throughout the country.
35.  To conduct meetings, propaganda and conferences in lawfully without any violence to get the rights of the people.
36.  To help the family of convicted persons as well as previous convict who are out of bar to make them as peace loving of the society and to live peacefully.
37.  To make arrangement of all kind of work for the planning of the government in regard to minors labors to frame rules and regulation in the state.
38.  To educate by spreading awareness among general public regarding adverse effects of smoking cigarette and bidi, drinking alcohol etc. by organizing camps, programs. And also organize the lectures by expert team of doctors, journalists and other learned persons on this issue.
39.  To work for the welfare of socially neglected people and to protest and fight against the injustice against people.
40.  To organize camps, training programmes, competitions, Seminars, conferences, symposiums, exhibitions, tours, Tournaments, games, run etc., in order to develop creativity, Personality and scientific outlook among youths.

41.  To provide the relief measures in those parts of the country which become affected due to natural calamities like famine, fire, flood, pestilence, Tsunami earthquakes or other act of nature, man made disaster and also educate them to know the prevention activities etc.
42.  To do cow welfare, providing shelter for needy cow, feeding and medicine services for cow, hospital and ambulance facility.
43.  To establish and run libraries, educational institutions, and old age homes for senior citizens and to provide nutritious food, clothing to the inmates of the old age home.
44.  To provide respite to persons caring for aged, ill or disabled persons by providing temporary care to aged, ill or disabled persons and by providing such services as housekeeping, meal preparation, nursing and other assistance .
45.  To systematically educate all people in the practice of cow protection in order to check the imbalance of values in life and to achieve real unity and peace in the world
46.  To establish and manage networking of voluntary and non-governmental organizations.
47.  To raise funds, accept gifts, donation, subscriptions in cash or in kind and any property either movable or immovable for the achievement of the objective of the society.
48.  To initiate award for the deserving people in the field of Music, Art, Sports at grass root level social service, communal harmony, brotherhood and peace.
49.  To aware people about their democratic & fundamental rights and to provide and facilitate legal assistance to underprivileged and poor section of society to fight for their rights and justice.
50.  To give support, aid to work for uplifting of the state of women, children & youth group by providing them education, training, assisting them in starting their own vocation and to such other things in this direction as may appear necessary for betterment of women at large.
51.  To purchase/acquire or take as grant or donation, land and/or building(s) in the name of the Trust and make construction thereupon for the purpose of its stated objectives.
52.  All the activities of the Trust shall be non-profitable and shall be done on a “no profit - no loss’’ basis.

3.      PROPERTY VESTED IN THE TRUSTEES

         The Trustees hereby transfer the sum of Rs. 1, 100/-(Rupees One thousand one hundred only)                 each in favor of the Trust. The above said amount shall be their initial contribution.

         The Trustees shall hold the said fund and other properties that may be endowed or conferred                   for the said Trust for the use and benefit of the Trust. The Trustees shall, out of the income                 realized from the properties endowed and such other endowments or donations, which they                          may get, pay all taxes and rates, where applicable, and all expenditure connected with the trust.                 Where such income is insufficient to meet the expenses, the trustees may use such portion of                                  the corpus of the Trust fund for the purpose, as may be found necessary and where the income                            of the Trust exceeds the expenditure of the Trust, such excess may be added to the Trust fund.

  The Bank A/c. of Trust shall be singly operated by Jitendra Kumar Yadav trustee or any person        authorised by him in writing or by his successor in the trust.

4. BOARD OF TRUSTEES

(a)    The Board of Trustees shall comprise the founding Trustees. The founding Trustees shall hold office for life. However any Trustee may resign by giving notice in writing to his/her co-Trustees.  Appointment of Trustees, either to fill up a vacancy or as additional Trustees, shall be by resolution of the founding Trustees.

(b)   The Trustees hereby declare that they for the time being, will hold the said sum and all gifts, contributions, subscriptions, donations, bequests and other moneys or property as and when the same shall be paid to or vested with them and the moneys, investments and property from time to time representing the same upon trust of object of general public utility not involving the carrying of any activity for the profit or for charitable purposes which tends to promote human welfare, providing however no part of the funds or income thereof be applied to any purpose outside India except in accordance with the approval with Central Board of Revenue, government of India and for such purpose, as defined in objects clause (2) above.

5.      POWER & DUTIES OF BOARD OF TRUSTEES

a.       To apply, the whole or part of the income or accumulation thereof or whole or part of the corpus of the Trust properties for one or more of the objects of the Trust as outlined in clause (2) above or as the Trustees may from time to time determine.

b.      To convert and get in the Trust property and/ or vary the investments for the time being and to invest and keep invest the Trust properties either in the purchase or mortgage of immovable properties or in shares, debentures or other securities/ investments and to alter, vary or transpose such investment from time to time as the Trustees, shall in their absolute discretion think fit. Provided, however, that accumulations of the income of the Trust properties, in respect of which notice has been given to the assessing officer under section 11(2)(a) of the Income-Tax Act 1961, shall only be invested in accordance with section 11(2)(b) the Act.

c.       To let or demise any immovable property comprised in the trust fund for such rent, on such terms and conditions, as the trustees in their absolute discretion shall think fit.

d.      To open account in the name of the Trust, with any Bank or Banks and to operate such account(s) and to give instructions to the bank and to provide for opening and operation of such account by one or more of the Trustees or any one or more agents appointed by the Trustees.

e.       To adjust, settle, compromise, compound, and refer to arbitration all actions, suits claims, demands and proceedings regarding the trust properties.

f.       To appoint constituted attorneys or agents and to delegate to such attorney or agents all or any of the powers vested in them under these presents from time to time and remove such attorneys or agents and to appoint other or others in his or their place.
g.      To appoint or make provision for the appointment of any persons (s) (including all or any of the Trustees) as committee or administrator or managing Trustee or otherwise for the purpose of the administration of the trust, in such manner and subject to such rules and regulations as the Trustees may prescribe.

h.      To make, vary, alter or modify schemes, rules and regulations for carrying out the objects of the Trust and for the management of the affairs thereof and of running any institutions in furtherance of the objects of the Trust and otherwise for giving effect to the objects to the Trust.

i.        To set apart to whole or part of the income or the corpus or part thereof for any of the objects of the Trust.

j.        The Trustees shall be chargeable only for such moneys, stocks, shares and funds, as shall actually come into their hands and shall not be answerable for neglect, default, acts of omission or commission of the other Trustees or of any banker or default, acts of omission or commission of the other Trustees or of any banker or other person with whom, the Trust properties and securities may have been deposited or handed over, unless caused by their willful neglect or defaults.

k.      The receipt of a person authorized by the Trustees or a resolution of the Board of Trustees for any moneys paid or any property transferred or delivered to Trustees in execution of the Trust or powers

l.        thereof or for the purchase moneys of any property authorized to be sold, shall effectually discharge any person or persons so paying or transferring or delivering.

m.    The Trustees will not be entitled to receive any remuneration as Trustees, but may reimburse themselves of all expenses actually incurred by them in connection with the Trust or their duties thereto.

n.      No Trustee shall refuse to be Chairman of the Board of Trustees, unless he/she shows his resentment to act as Chairman for a specified or unlimited duration. The Chairman shall be entitled to call the meeting of the Board of Trustees and preside over the meeting. The Board of Trustees may from time to time frame all other rules for the conduct of the administration of the Trust and regulating the meeting of Trustees, which are not covered in this deed.  In the absence of such regulations:

o.      Majority will decide all matters and two Trustees shall form a quorum for meeting of Board of Trustees.

p.      Resolution passed without any meeting of the Board of Trustees and evidenced in writing under the hand of two thirds of the Trustees shall be as valid and effectual as a resolution duly passed at a meeting of the Board of Trustees.

q.          Proper Books & Accounts shall be maintained by the Trust and shall be audited by an independent firm of chartered accountants. M/s R K Verma & Associates, Chartered Accountants having its office at 304, Pratap Complex, R – 20, Shakarpur, Delhi shall be auditor of the trust for the first and subsequent financial years and may be removed at any time by an amendment in the trust deed.

r.                The Trustees shall maintain the minutes book, in which the proceedings of all meetings of Trustees shall be recorded by the Trustees and the Chairman of the meeting shall sign the same.

6. CUSTODY OF DOCUMENTS
The Chairman or his/her nominee or any other Trustee, if so authorized by the Board of Trustees, shall have the custody of all the documents, deeds of title, relating to the Trust properties and investment, and the books of account and the other record relating to the Trust and shall be responsible for the preservation of the same.

7. ADVISORY BODY AND CONSULTANT
The Trustee may maintain a set of Advisors for therof utilizing their services in furtherance of the objects of the trust.

8. FINANCIAL YEAR
The financial year of the Trust shall end on 31st March every year provided that the Board of Trustees shall be at liberty to change the same from time to time if they so deem fit and proper.

9. ACCOUNTABILITY OF THE TRUSTEES
The Trustees, without prejudice to any other statutory or other right to indemnification that they may have, shall be jointly and severally indemnified out of the Trust Fund at all times in respect of each and every claim made against them or any of them whether in their capacity as Trustee or Trustees or personally in respect of any liability arising from or in respect of the Trust, its affairs, administration or activities or any aspect of any of the same PROVIDED ALWAYS that the right of a Trustee to an indemnity under this clause shall not extend to any claim arising from willful fraud or wrongdoing or wrongful omission or commission on his part.

10. INDEMNITY OF TRUSTEES
a)      The Trustees may reimburse themselves and pay and discharge out of the Trust Fund all expenses incurred by them in or about the execution of the Trust as specifically authorized by the Trust in the meeting of the Trustees, or any of their duties under these presents including traveling expenses, but will not be entitled to receive any remuneration for the services to be rendered by them as Trustees. The expenses incurred by them in this regard will be reimbursed to them only if the same are approved in a meeting of the Board of Trustees.

b)      The Trustees shall be accountable only for such moneys, contributions and funds as shall actually come into their hands and a Trustee shall not be answerable or accountable for neglect, default, acts or omission or commission of the other Trustees, nor of any banker or other person with whom the Trust properties or any securities may have been deposited or kept for furtherance of any one or more of the objects of the Trust.


11. UTILIZATION OF TRUST PROPERTY
If the income from the Trust property in a particular year is not fully utilized, the unspent income, subject to the applicable provisions of the Income Tax Act, 1961, shall be carried over to the next year or years and spent in such subsequent year or years for achieving the objects of the Trust.


12. BENEFITS OF THE TRUST
The Benefits of the Trust activities in terms of the educational, training and related services it provides shall be available to all Indians, irrespective of caste, creed, age, sex, or religion.



13. ADDITIONS TO THE CORPUS
The Trust Fund may be added to, by the income from the initial fund and also by donations and other contributions from time to time.

14. DISSOLUTION OF TRUST
The Trust may be dissolved by mutual and voluntary agreement of the Trustees. No force or coercion shall be brought about by a Trustee to bear upon the other Trustee(s) for the purpose of bringing about dissolution of the Trust.  On dissolution of the Trust, all the properties and other funds of The Trust whether with the Trustees or anywhere else shall be either utilized in full for the object of the trust or shall be vested in some other Trust or any other form of public charitable organization having similar objects.  

15. IRREVOCABILITY
It is declared that the Trust is irrevocable. If the Trust fails for any reason, in the opinion of the Trustees, the net assets of the Trust, both movable and unmovable shall be handed over to any Trust having the same object, as decided by the majority of the Trustees.
